La venta ambulante volvió al centro de la escena en Neuquén. En las últimas semanas, una serie de operativos municipales contra puestos de frutas y verduras en veredas céntricas y accesos a shoppings derivó en tensiones con los comerciantes informales, en algunos casos con desalojos conflictivos. La situación encendió el debate en el Concejo Deliberante, que busca un equilibrio entre la normativa vigente y la realidad económica que empuja a muchas familias a salir a la calle a vender.
El oficialismo no evalúa flexibilizar la prohibición que rige sobre este rubro, pero sí plantea alternativas para integrar a los vendedores en las ferias barriales ya existentes. La discusión pone sobre la mesa un dilema que atraviesa a la ciudad: cómo conciliar la subsistencia de cientos de trabajadores informales con la regulación y el control municipal.
En Neuquén, la ordenanza 12.587 prohíbe la venta ambulante de frutas y verduras. El texto solo permite ciertos alimentos bajo condiciones específicas, como pochoclos, garrapiñadas, churros o panchos, y establece que las ventas deben realizarse con carritos o mesas móviles, retiradas una vez finalizada la jornada. La modalidad de “manteros” en la vía pública está expresamente vedada.
Aun así, el microcentro y algunas esquinas transitadas concentran entre 20 y 25 puestos de frutas y verduras que resisten a desaparecer. Los feriantes aseguran que cuentan con el respaldo de clientes habituales, e incluso mencionan presentaciones judiciales para poder seguir trabajando. Sin embargo, reconocen que sus ventas cayeron a menos de un tercio de lo que solían generar.
Desde la comisión de Legislación, su presidenta Victoria Fernández (MPN) aclaró que no se busca flexibilizar la ordenanza, sino “canalizar la actividad hacia los espacios habilitados”, en referencia a las ferias barriales supervisadas por la Municipalidad. La funcionaria recordó que la prohibición responde a criterios bromatológicos y sanitarios, y que en los últimos operativos también se secuestraron huevos y otros productos sin habilitación.
Las ferias barriales, la alternativa oficial
Actualmente, Neuquén cuenta con 18 ferias distribuidas en distintos barrios y horarios. Allí, los vendedores deben realizar cursos de manipulación de alimentos, se someten a controles municipales y encuentran un marco regulado para comercializar. Antes de la pandemia solo existían ocho, pero la red se expandió tras el aislamiento sanitario.
Las ferias más concurridas funcionan en el Parque Central, los Arcos Romanos, Racedo y Novella, La Pergolita y Villa Ceferino, además de otros puntos en barrios como Alta Barda, Parque Oeste y Melipal. Además de frutas y verduras, se ofrecen panificados, conservas y productos caseros.
Para el municipio, este esquema garantiza condiciones sanitarias adecuadas y oportunidades de crecimiento para los pequeños productores. Sin embargo, muchos vendedores ambulantes desconfían de poder sostener allí el mismo nivel de ingresos y, sobre todo, de conservar la clientela que logran captar en las zonas céntricas de mayor tránsito.
Economía familiar y un debate abierto
La inflación persistente, la pérdida de poder adquisitivo y los despidos empujan a numerosas familias a la informalidad como única salida laboral. En ese contexto, la venta en la vía pública funciona como un recurso de subsistencia, aunque en tensión con las normas municipales.
El Concejo Deliberante deberá resolver en los próximos meses si impulsa cambios en la normativa o si profundiza los mecanismos de inclusión a través de programas sociales y ferias organizadas. Mientras tanto, cada operativo de control vuelve a poner de relieve un conflicto que mezcla economía, seguridad sanitaria y la vida cotidiana de la ciudad.
