El Gobierno de Javier Milei abrió la puerta a un nuevo ciclo de endeudamiento externo al autorizar, por decreto, operaciones de financiamiento en dólares por hasta USD 5.000 millones con bancos y entidades financieras internacionales, bajo legislación extranjera. La medida, formalizada en el Decreto 478/2026, vuelve a colocar a la Argentina bajo la órbita de los tribunales de Nueva York al habilitar la prórroga de jurisdicción a favor de cortes estaduales y federales de esa ciudad, repitiendo el esquema que en el pasado derivó en largos litigios con fondos buitre tras el default de 2001. Lejos de pasar por un debate profundo en el Congreso, la decisión se apoya en la firma del Presidente, el jefe de Gabinete y el ministro de Economía, consolidando un modelo de toma de deuda por vía administrativa que reduce al mínimo el control político y social sobre el endeudamiento.
El argumento oficial es que estos préstamos, respaldados con garantías parciales de organismos multilaterales de crédito, permitirían “reducir el costo de financiamiento” del Tesoro Nacional. Pero el decreto no detalla destinos productivos, obras concretas ni criterios de asignación, reforzando la sospecha de que se trata de deuda para tapar baches fiscales y sostener el esquema financiero del ajuste antes que para impulsar un cambio estructural de la economía. En un contexto en el que el riesgo país sigue siendo elevado y la tasa potencial de cualquier emisión continúa siendo alta, recurrir a nueva deuda en lugar de discutir una estrategia de desarrollo de largo plazo implica profundizar la dependencia respecto de los mercados y de los organismos internacionales, condicionando todavía más la política económica futura.
El texto habilita además la renuncia a la inmunidad de jurisdicción, es decir, el consentimiento a ser demandado en tribunales extranjeros, aunque mantiene formalmente la inmunidad de ejecución para ciertos activos estratégicos como las reservas del Banco Central, bienes de dominio público, sedes diplomáticas y bienes militares. Sin embargo, la experiencia argentina muestra que estas cláusulas pueden abrir grietas jurídicas que luego son aprovechadas por acreedores para presionar con embargos, tal como sucedió con los reclamos originados en el default de 2001 que se tramitaron durante años en cortes de Nueva York. El propio decreto faculta al Ministerio de Economía a negociar plazos, tasas, comisiones, honorarios y a contratar bancos colocadores, agentes fiscales y todo el aparato técnico de una operación financiera internacional, pero siempre bajo parámetros de “mercado”, lo que implica aceptar las condiciones de un sistema que históricamente ha colocado a la Argentina en posición subordinada.
La decisión se inscribe en una tendencia más amplia de gobiernos, tanto nacionales como provinciales, a incrementar su endeudamiento en moneda extranjera sin precisiones claras sobre el uso de los fondos y con una oposición limitada en los ámbitos legislativos.
